General Terms and Conditions for Business Customers
1. Scope and Validity
1.1 These Terms and Conditions apply exclusively to all business relationships between Bavaria’s Best Beer (hereinafter “BBB”) and our business customers.
1.2 We exclusively serve business customers (B2B). Minimum order quantity is one container with 400 cases.
2. Products and Services
2.1 BBB supplies Bavarian beer from over 60 breweries for export purposes.
2.2 Products are sold by container only. Minimum order: 400 cases per container.
2.3 We cannot guarantee consecutive batch numbers or uniform best-before dates within one container.
2.4 Empty bottles and deposit values are not refunded or credited.
3. Order Process
3.1 All offers are non-binding and subject to availability.
3.2 Orders become binding upon our written order confirmation.
3.3 Order processing is typically completed within seven (7) business days. In exceptional cases, longer processing times may occur. Customers will be immediately notified of any delays.
4. Prices and Payment
4.1 All prices are quoted EXW (Ex Works) Freising, excluding VAT and shipping.
4.2 Payment is required in advance (prepayment) before order processing begins.
4.3 Orders are non-cancellable once payment has been received.
5. Delivery and Shipping
5.1 Customer is responsible for:
- Providing the shipping container
- All shipping arrangements and costs
- Container pickup from our warehouse in/near Freising
- All import duties and taxes
5.2 We recommend using ventilated containers for optimal product quality.
5.3 We can assist with logistics coordination for an additional fee.
5.4 Risk of loss or damage transfers to customer upon loading completion at our warehouse.
6. Liability
6.1 BBB is not liable for any damage during transport after goods leave our warehouse.
6.2 Customer is responsible for compliance with all import regulations in destination country.
6.3 Our liability is limited to the invoice value of the affected goods, except in cases of gross negligence or intent.
7. Applicable Law
These terms are governed by German law. Place of jurisdiction is Munich, Germany.
